Terms of Service

1. Acceptance of Terms

By accessing or using the eShops platform at eshops.bd ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. Description of Service

eShops provides a software-as-a-service (SaaS) platform that enables users ("Sellers") to:

  • Create and manage e-commerce landing pages
  • List and sell products
  • Receive and manage customer orders
  • Connect custom domains
  • Integrate analytics and tracking tools

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to create an account.
  • One person or entity may not maintain more than one free account.
  • You are responsible for all activity that occurs under your account.

4. Seller Responsibilities

As a seller on the Platform, you agree to:

  • Comply with all applicable local and national laws and regulations
  • Not sell prohibited, illegal, or counterfeit products
  • Provide accurate product descriptions and pricing
  • Fulfill orders in a timely manner
  • Handle customer complaints and disputes professionally
  • Not use the Platform for fraudulent purposes

5. Prohibited Content

You may not use the Platform to sell or promote:

  • Illegal drugs or controlled substances
  • Weapons, explosives, or ammunition
  • Stolen or counterfeit goods
  • Adult or sexually explicit content
  • Content that infringes intellectual property rights
  • Products that promote hate, violence, or discrimination
  • Any products prohibited under the laws of Bangladesh

6. Pricing & Payments

  • Free plan features are available at no cost with usage limits as described on our pricing page.
  • Paid plans are billed monthly and may be cancelled at any time.
  • All prices are listed in Bangladeshi Taka (BDT) unless otherwise stated.
  • We reserve the right to change pricing with 30 days advance notice.
  • eShops does not process payments between sellers and their customers. Payment collection is the seller's responsibility.

7. Intellectual Property

  • The eShops platform, including its design, code, and branding, is the property of eShops.
  • Content you create (product listings, landing pages, images) remains your property.
  • You grant eShops a license to host and display your content as necessary to operate the Platform.
  • You must not copy, modify, or reverse-engineer any part of the Platform.

8. Store Subdomains

  • eShops owns and operates the domain eshopstore.bd.
  • When you create a store, eShops automatically assigns your store its own subdomain in the form your-store.eshopstore.bd. Your storefront and order pages are published at this address.
  • Each store's subdomain is delegated to and controlled by that individual store owner. Subdomains are independent of one another and are not operated as a single shared site.
  • Your assigned subdomain is unique, is reserved for your store, and is fixed once your account is created (it cannot be changed afterwards).
  • You may additionally connect a custom domain you own (see the next section).

9. Custom Domains

  • You may connect custom domains you own to your eShops store.
  • You are responsible for domain registration, renewal, and DNS management.
  • eShops is not liable for domain-related issues outside our platform.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance with or without prior notice. We are not liable for any loss resulting from service downtime.

11. Termination

  • You may close your account at any time by contacting support.
  • We may suspend or terminate your account for violation of these Terms.
  • Upon termination, your data will be retained for 30 days and then deleted.
  • Outstanding orders must be fulfilled before account closure.

12. Limitation of Liability

To the maximum extent permitted by law, eShops shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising from your use of the Platform.

Our total liability for any claim shall not exceed the amount you paid to eShops in the 12 months preceding the claim.

13. Dispute Resolution

These Terms are governed by the laws of Bangladesh. Any disputes shall be resolved through the courts of Dhaka, Bangladesh. We encourage you to contact us first to resolve any issues informally.

14. Changes to Terms

We may modify these Terms at any time. Significant changes will be communicated via email or platform notification at least 15 days before taking effect. Continued use of the Platform after changes constitutes acceptance.
